TeachLogic, LLC (“TeachLogic”) warrants to the original end-user purchaser, that TeachLogic-branded products will be free from defects in materials and workmanship under normal installation, use and service for the periods as set forth below:
FIVE (5) Years from date of purchase as reflected on a TeachLogic invoice: Microphones/transmitters, amplifiers/receivers, IR sensors, speakers, power cords, power supplies and drop-in battery chargers
THREE (3) Years from date of purchase as reflected on a TeachLogic invoice : User control panels, controllers, and related cabling and enclosures
TWO (2) Years from date of purchase as reflected on a TeachLogic invoice: Lithium batteries
TeachLogic does not warrant that the software will operate without interruption or will be error-free.
Under this warranty, TeachLogic agrees, at its option, to either repair or replace any defective part or component at no charge to the customer. Return shipping charges will be paid by TeachLogic. Warranty shipments must be accompanied by a Return Authorization Number issued by TeachLogic. For specific instructions on requesting a warranty repair, please visit www.teachlogic.com
This warranty only extends to those products purchased from a TeachLogic authorized dealer or representative and installed in accordance with TeachLogic published guidelines which include, but are not limited to, technical manuals, specifications and service communications. End-user purchaser is obligated to promptly install any firmware or other changes or updates provided by TeachLogic when recommended by TeachLogic.
No agent of TeachLogic is authorized to alter or exceed the warranty obligations set forth herein.
The warranty period is not extended by the repair or replacement of any product under the terms of the above warranty.
This Warranty does not apply:
a) to damage caused by accident; abuse; misuse; unauthorized modifications or alterations; failure to follow operating instructions; improper site preparation; external interference; insects; excess heat or moisture; fire; theft; power surges; connections to improper voltage supplies; Acts of God; use of unauthorized installers or repair shops; failure to install, use or maintain the product in accordance with manufacturer’s guidelines including the installation of firmware updates; external sources; or use with non-TeachLogic components or products, including, but not limited to, loudspeakers, AV connection plates, amplifiers, switches, public address systems, and cabling; and
b) to protective coatings; cosmetic damage; or defects caused by normal wear and tear.
TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY SHALL BE IN LIEU OF ANY OTHER WARRANTY, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR WARRANTY AGAINST HIDDEN OR LATENT DEFECTS. TEACHLOGIC SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES, FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF REVENUES OR PROFITS, INCONVENIENCE, LABOR COSTS, EXPENSE FOR SUBSTITUTE EQUIPMENT OR SERVICE INCLUDING BUT IN NO WAY LIMITED TO STORAGE OR FREIGHT COSTS, LOSS OR CORRUPTION OF DATA, OR ANY OTHER SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY THE USE OR MISUSE OF, OR INABILITY TO USE, TEACHLOGIC PRODUCTS, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, EVEN IF TEACHLOGIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
INSOFAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, TEACHLOGIC LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT TEACHLOGIC’S OPTION, TO THE REPAIR OR REPLACEMENTOF THE DEFECTIVE PRODUCT. IN NO EVENT SHALL RECOVERY OF ANY KIND AGAINST TEACHLOGIC BE GREATER IN AMOUNT THAN THE PURCHASE PRICE PAID TO TEACHLOGIC OF THE PRODUCT SOLD BY TEACHLOGIC AND CAUSING THE ALLEGED DAMAGE.
UNDER NO CIRCUMSTANCES WILL TEACHLOGIC BE RESPONSIBLE FOR ANY EXPENSE IN CONNECTION WITH ANY REPAIRS MADE BY ANYONE OTHER THAN THE FACTORY OR AUTHORIZED SERVICE STATION UNLESS SUCH REPAIRS HAVE BEEN SPECIFICALLY AUTHORIZED IN WRITING BY TEACHLOGIC.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY HAVE OTHER LEGAL RIGHTS, WHICH MAY VARY, FROM STATE TO STATE.
SOME STATES DO NOT PERMIT THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS EXCLUSION MAY NOT APPLY TO YOU.
THIS DISCLAIMER AND EXCLUSION SHALL APPLY EVEN IF THE EXPRESS WARRANTY SET FORTH ABOVE FAILS ITS ESSENTIAL PURPOSE.
